The Florida governor has been given a bill that will give him the authority to order that Terri Schiavo’s feeding tube be replaced. Apparently one of the husband’s lawyers has gone to a judge to ask him to stop Govenor Bush.

How many lawyers does he need to get his hands on the money he wants?
This statement doesn’t make sense to me.
“I do not believe the governor of Florida should be making a decision of life and death rather than the next of kin,” said Sen. Steven Geller, D-Hallandale.
Isn’t this a next of kin battle that has been going on for 10 years?
If he is referring to the letter of the law which gives the husband priority over the parents, why doesn’t the law recognize the husband is acting in his best interests and not the interests of his wife?
That isn’t always the case, but a 10 year fight might be a clue.
Public reponse might be a clue.
World wide outrage might be a clue.
The article does go on to explain the law a bit.
A lot of lawyers are making a lot of money.
There is a sick irony in this being a starvation case. I think of greed as something that chokes off, cuts off, takes away from, shrivels a soul, or in this case, many souls. I see greed as really skinny. Collective wisdom doesn’t perceive greed as green for nothing.
I think of this woman’s caregivers too. Some of them are fond of her, many see caring for the disabled as more than a paycheck. How horrible to have the law tie your hands behind you and make you stand by and watch her starve to death.
As I write this, the governor hasn’t signed the bill and Terri Shaivo is still starving to death.
The latest: Florida’s governor has signed the bill.
George Felos, an attorney for Michael Schiavo, said he thought the legislation was unconstitutional. He said it was Terri Schiavo’s right under the Florida Constitution not to be kept alive artificially.
A state Appeals Court judge denied Felos’ request for a restraining order stopping Bush from ordering the feeding tube restored, NBC affiliate WFLA of Tampa reported. But the judge said he did so on technical grounds and told Felos he could refile the request.
Perhaps The Mighty Barrister can post on this latest development and possible outcomes. Sir?

The wrong side of the bed
I can’t say I got up on the wrong side of the bed this morning, there is no right or wrong side. I merely got up on the other side of the bed from the usual one.
I remain completely discombobulated today.
If it wasn’t just stumbling out the other side necessarily, it was the immediate breaking of the wake up routine I allow myself, that usually gets the neurons firing. I had some pretty wild nightmares last night, but thankfully no sleep paralysis. I woke myself up yelling a few times.
Right away I wasn’t awake enough to notice what I was doing and got bombarded with some outside things that deviate from the normal ‘not a morning person’ ‘give yourself some time’ routine.
I’m still in the all day fog. Nothing is sinking in. I can’t think. Maybe it’s the cold weather that descended abruptly. It’s been a lost day. I concede defeat, and will try to kick the brain into gear tomorrow after some extra healing sleep.

Yeah, I know the feeling when you get up on the wrong side of the bed. And the bed’s against the wall.
But it is good news for Terri, although the war has not yet been won. The whole sad story is almost beyond belief.
I hope that you have gotten some healing rest, Bene. My habits are so deeply ingrained that I sleep on the same side of the bed, whether I am alone or with my husband. It’s very disorienting for me to sleep on the other side of the bed, as in a hotel where the alarm is on the “wrong” side.
The matter could be simply resolved. What is in the best interest for Terri? Who has her best interest at heart? We know that it is her mother and sisters so gaurdianship should be turned over to them. Mr schiavo has proven for years that his own best interest is being served in his wallet.
She could have been re-abilitated, Agressive treatment could have been started years ago. Why wasn’t it? The courst dragged their heels on this one. Now that the feeding tube has been replaced I pray to God it wasn’t too little, too late. Kathi
well, my heart goes out to Terri’s family but no matter who is right or wrong in this situation, it is the husband’s ultimate decision. Whatever his interest waas/is, she has been in this state for too long and I am positive anyone would agree they would not want to live like that. The fight within the family does not change the fact that she will most likely never get out of that bed and if she did, her life probably would not be much more than it is now. If it weren’t for that feeding tube, she would have died already. If it will kill her now to take it out, it would have happened had she not had the tube, and who is a husband, mother, doctor, or governor to play God?
I need a soul mate, I’m very succesful and Financially stable.

Florida criminalizes abuse, neglect and exploitation of a disabled adult.
In the criminal statutes, “neglect” is defined as
1. A caregiver’s failure or omission to provide an elderly person or disabled adult with the care, supervision, and services necessary to maintain the elderly person’s or disabled adult’s physical and mental health, including, but not limited to, food, nutrition, clothing, shelter, supervision, medicine, and medical services that a prudent person would consider essential for the well- being of the elderly person or disabled adult; or
2. A caregiver’s failure to make a reasonable effort to protect an elderly person or disabled adult from abuse, neglect, or exploitation by another person.
Fla. Stat. § 825.102(3)(a).
If the neglect results in “great bodily harm, permanent disability, or permanent disfigurement” to the disabled adult, it’s a second degree felony. If there is no such harm, it’s a third degree felony.
Fla. Stat. § 825.102(3)(b), (3)(b)
In the Schiavo case, Judge Greer has authorized the removal of her feeding tube, pursuant to the mandate from the Second DCA.
Judge Greer also denied the parents’ Petition for Immediate Therapy, requesting an attempt to help Terri learn to eat by mouth again.
Judge Greer HAS NOT entered an order forbidding provision of food and water by mouth after the removal of the tube.
In addition, Fla. Stat. § 744.3215 lists certain rights retained even after a person is adjudicated to be incapacitated. If one takes the rather broad language in 1.1 above, Schiavo’s systematic violation of those rights can also be the subject of criminal charges, as his violations have NEVER been adjudicated by the guardianship court.
