Gordon Driver/Axcess Automation/Axcess Funds criminal investigation

A Freelton man implicated in a $14-million Ponzi scheme is now the subject of a U.S. criminal investigation by the California state attorney’s office.

Gordon Driver and his company, Axcess Automation, are already facing court actions launched by the U.S. Securities and Exchange Commission, which alleges that Driver and his company defrauded more than 100 Canadian and U.S. investors by promising them weekly returns on their investment as high as 5 per cent.

The SEC has obtained a court order freezing Driver’s assets and is also seeking financial penalties and an order that would force Driver to turn over any money he has obtained from investors.

Driver will be back in a Los Angeles court today, hoping to convince a judge to release $35,000 of the frozen funds so that Driver can hire a lawyer to defend himself in the case against the SEC.

In his court motion, Driver acknowledges he is also now the subject of a criminal investigation and that he has been provided with a public defender to protect his rights in that case.

The Hamilton Spectator also notes that Driver told the court he has access to three banks accounts with less than $100 in them and that he and his wife are not working.  He has stated he is living in rental housing in Las Vegas.  

A title search in  indicates his home in the Hamilton Ontario area is owned by an unknown comapny, 555483 Ontario Limited. A couple of readers of BDBO have said he rented in the Freelton area. Gordon Driver told The Hamilton Spectator he and his wife had no ownership in the Ontario numbered company. 

He declined to speak to The Spectator about the criminal investigation in the US and has been assigned a public defender for the California criminal probe.

In a civil court appearance today in California Central District Court, Driver is seeking release of 35 thousand dollars from assets frozen by the SEC in May to obtain legal counsel. 
The SEC and CFTC believe a million dollars is missing in the alleged 14m ponzi scheme which came to light in May of this year, the civil case cannot move forward until Gordon Driver gets a lawyer. His company was not registered to sell or trade securities in the US or Canada.

Axcess Automation claimed development of a software trading program.

Gordon Driver told the SEC that Ron and Reynold Mainse of 100 Huntley Street were finders for Axcess Automation/Axcess Funds, as well as investors.
Reynold Mainse has told friends in an email he brought in 15 people, and is co-operating with The Ontario Securities Commission.

Both Ron and Reynold Mainse were taken off the air in June after a Hamilton Spectator article in May. 
Mainse cousin David Rutledge, who was the former Director of Ministries for Crossroads Christian Communication, is named in a OSC temporary order halting all Axcess activity in Canada.
No charges have been laid against the Mainse brothers or Mr. Rutledge. 
An forensic audit of Crossroads Christian Communications indicated no charity/donor funds were used were used for Axcess Automation/Funds. 
Ron Mainse is Director of broadcasting interests for Crossroads Christian Communications, Reynold is VP of Missions. Both hosted 100 Huntley Street.
Founder David Mainse kicked off the Crossroads Christian Communications 100 Huntley Street fund raising week today asking donors for a ‘faith promise’ stating Crossroads needed to raise 1/2 million dollars before the end of the month.  His sons remain off air.

The question remains open for me, how many investors were pulled into the alleged ponzi scheme through direct actions of Crossroads employees?

    Does anyone believe 100 Huntley will survive this?

    Founder David Mainse kicked off the Crossroads Christian Communications 100 Huntley Street fund raising week today asking donors for a ‘faith promise’ stating Crossroads needed to raise 1/2 million dollars before the end of the month.

    This tragedy occurred in 2007 and continued till the spectator published their article in May?

    My question where is the honesty with the Mainse? how can the general public continue to believe that there is no dishonestly in the camp!

    Has David Mainse expressed any deep and profound public concern for the investors who have lost so much? He could do that on TV and other media without prejudice to the circumstances that have given rise to the alleged involvement of his sons in the alleged ponzi scheme, both of whom are and must continue to be presumed innocent unless found otherwise.

    Showing care and concern for each and all is surely what Jesus would do?
