I’ve received information from a former investor with Gordon Driver/Axcess Automation/Funds and spent the day attempting to source and verify. I was unsuccessful in contacting an official source.
This could be a rumour and I an choosing to post this anyway, albeit reluctantly for my failure to verify.
I’m not a lawyer and I don’t play one on the blog.
Please remember this has come from one source with incomplete information, yes or no needs to come from the Public Defenders Office in LA. I don’t have the resources to contact them by phone.
I think Axcess investors deserve information and I’m doing all I can to confirm or deny this is a rumour.
If you can help, 100+ investors would be grateful, as would I.
On August 11, 2009 in the civil suit brought by the SEC/CFTC against Gordon Driver/Axcess Automation/Funds; Judge Wright denied a motion to unfreeze funds for Mr. Driver’s defense in the civil case on the grounds argued by the defense that the money frozen belongs to victims.Â
There was no further civil date set, Driver was given 45 days to comply with the court request to get a lawyer.
The 45 days have passed. In the civil case, the FBI observed and at some stage Gordon Driver was assigned a public defender to assist him with a possible criminal investigation.
The rumour I can’t currently source is that a grand jury was recently convened in LA to hear witnesses in the Driver/Axcess case.
Grand juries are secret proceedings and have one role. The prosecutor hears witnesses, the jury recommends whether there is probable cause or not for the case to proceed criminally.
The known 15 US investors and the approximately 85 Canadian investors have heard nothing since August and deserve to know what is occurring in the US courts. The silence has been long.
I do not know when the findings of the rumoured grand jury will be released, it depends on when (or if) they met.
I would like verification this took place, investors also have the right to know; if it did, I hope this is not a rumour and gives people assurance this situation is moving forward.
For those with the resources perhaps contacting the LA Public Defenders Office (by phone) to seek verification of this rumour and posting the information here - will encourage the discouraged. (1-213-974-2311)
I’m sorry I don’t have a long distance plan, there is no email addy with the Public Defenders office  I could find to use to ask. The California Court System and the Grand Jury site didn’t yield what I was looking for.
 Gordon Driver responded, he has chosen not to answer to my question on whether a grand jury met, as well I’ve written a reporter with the resources to check, The Trinity Foundation in Dallas, and a friend of Gordon Driver in California. I have not yet heard back from any of them. I’ll post when I do.
1) If I find this grand jury story is a rumour I will correct it immediately.
2 If convening of a grand jury is true, I’ll update,  and encourage interested parties to watch for release of a decision.
To Axcess investors, do not lose hope.
The Alternative Public Defender’s office has a email address-lacapd@apd.lacounty.gov. They supplement the main PD’s office when there’s a conflict of interest, like when two guys are charged with the same crime and need independent representation.
The instructions notes not to email “about cases” but they’re most likely talking about clients rather than a member of the public inquiring about a grand jury’s existence.
I can’t guarantee that they’ll help, but it’s a start.
I did note the copious lack of a single e-mail address for the main PD’s office on their website. Feels more like 1996 than 2009.

Ponzi schemes have been around for quite while even in the house of God as my book “Not Innocent” details! And they seriously hurt many people especially the elderly as they rob them of their life savings and the ability to live properly causing many to suffer and even die prematurely!
Contrary to the opinion of most people, God rules and reigns on earth and He is the one who is bringing out the knowledge and awareness of Ponzi crimes using His other media including Law Enforcement and the News Media.
The News media has always been a great tool to bring to people the awareness of things including “Robber Barons”, rapists, and serial killers as well as other crimes.
And in my opinion the blind egotistical Mainse brothers and Gordon Driver are guilty of greater things not just being involved in Ponzi crimes which is just the tip of the iceberg! The bible tells us:

Yes. Depends on the charges.
I haven’t done a through look up yet, but if there are criminal charges filed (either through the two provincial polices forces in Ontario and Quebec or the RCMP in the rest of the provicinces and territories) and if a regulatory board has the clout to proceed legally: there are fines and imprisonment.
I’ll have a look see through the criminal code when I have a bit more time.
